Regulations

Regulations governing the on-line purchase of tickets
to the Botanical Garden of the University of Wrocław

The herein presented set of Regulations defines the rules which pertain to the Internet purchase of admission tickets to the Botanical Garden, located in Wrocław at 23 Sienkiewicza Street.

§ 1
The terms used in the Regulations convey the meaning as defined below:

  1. Seller – Botanical Garden of the University of Wrocław, 1 Uniwersytecki square, 51-137 Wrocław, Tax ID: 8960005408, REGON: 000001301, telephone: + 48 71 322-59-57, fax: + 48 71 322-44-83, e-mail: ob@uwr.edu.pl. Contact with the Seller possible by phone or the address above indicated.
  2. Purchaser – a person who has made an on-line purchase of an Electronic Ticket.
  3. Electronic Ticket – an electronically generated confirmation of the agreement drawn between the Seller and the Purchaser, based on which the Purchaser is entitled to one-time admittance to the Botanical Garden, located in Wrocław at 23 Sienkiewicza street, on the date specified in the Electronic Ticket and within the opening hours of the Garden.

§ 2
On-line sale

  1. The sale and distribution of Tickets is executed by the Botanical Garden via the following website: www.bilety.ogrodbotaniczny.wroclaw.pl in compliance with the valid price list, which is available at www.ogrodbotaniczny.wroclaw.pl.
  2. Accomplishment of Ticket purchase in the on-line system is equivalent to acceptance of the Regulations in force. Usage of the software dedicated to Ticket purchase and choice of the BUY option are possible after prior acceptance of the present Regulations and of the Regulations which concern admittance to the Garden. Both sets of Regulations are available on the website. On-line purchase of Tickets is possible after prior registration at the following website address: www.bilety.ogrodbotaniczny.pl, and after acceptance of the clauses pertaining to the consent to personal data processing.
  3. A ticket to the Botanical Garden in Wrocław which has been purchased electronically is valid within a given season or specified period until it is used for single admittance. 

  4. The Garden is entitled to implement changes in the Regulations. A modified set of Regulations shall be made public at website address as follows www.ogrodbotaniczny.wroclaw.pl.
  5. All prices included in the price list are expressed in PLN and include the VAT tax.
  6. In order to obtain a VAT invoice, correct data indispensable for the invoice to be drawn should be provided during the process of Ticket ordering. The invoice will be dispatched to the e-mail address given by the Purchaser while making the order.
  7. There is a possibility to obtain a VAT invoice immediately after the Tickets have been purchased on-line. In this case, the Purchaser should send an e-mail, specifying the correct data for the invoice to be drawn, to the following address: ob@uwr.edu.pl.
  8. The up-dated schedule of days and hours when the Garden is available to guests can be found at website: www.ogrodbotaniczny.wroclaw.pl.
  9. Registration at www.biety.ogrodbotaniczny.pl website is possible after filling in the customer's name, surname, e-mail address and after entering the selected password.
  10. The Ticket sales contract between the Purchaser and the Botanical Garden is concluded when the following procedures required for on-line ticket purchase are completed:
    1. registration of the Purchaser,
    2. placing an on-line order by the Purchaser,
    3. completing the on-line payment for the order through the Purchaser's bank account or by credit card,
    4. acquisition by the Purchaser of the confirmation, sent to the provided e-mail address, that the transaction has been carried out.
      Each person who is buying an on-line Ticket will be sent – to the e-mail address given in the registration form – a reply message with notification whether the order has been delivered to the Garden and whether the customer has already got a registered profile.
      A requirement for successful registration is that correct data are entered into the registration form.
      The Garden reserves the right to delete any account which has not correctly been logged-in for the past 24 months.
  11. It is possible to purchase an on-line Ticket without the necessity to register at www.bilety.ogrodbotaniczny.wroclaw.pl website.
    In order to purchase an Electronic Ticket, the Purchaser should make an order by selecting a specific date for the intended visit to the Garden and filling in the order form, which should include: the name and surname of the Purchaser, e-mail address, telephone number, address and Tax ID (when the Purchaser wants to receive an invoice), and the type (regular, reduced) and number of tickets.
  12. In the case of on-line purchase of tickets, the payment is executed through an electronic bank transfer or by credit card.
  13. Until the Purchaser's payment has been confirmed, the Ticket remains the property of the Garden. If the payment is not confirmed within an hour from the moment of submitting the order, the order is subject to automatic cancellation. The payment is acknowledged as completed at the moment the Seller receives a notification about money transfer to the Seller's bank account.
  14. The Garden takes no responsibility for the consequences of incorrect or erroneous data entered into the order form.
  15. Each transaction of on-line Ticket purchase will be assigned its own number. The Purchaser will be sent – to the indicated e-mail address – an Electronic Ticket in the PDF form, ready to be printed on their own, within an hour from the moment the Seller receives a notification about the pertinent money transfer to their account.
  16. The Purchaser is responsible for protection of Tickets and their safe storage since there is no possibility of tickets to be re-sent.
  17. Customers who have bought reduced Tickets in the on-line purchase system are obliged to show the document which authorizes them to the discount. A reduced ticket is available to:
    1. children over 3 years of age;
    2. pupils of primary and secondary schools (excluding adult education);
    3. students up to 26 years old (except for students of the University of Wrocław Faculty of Biological Science and students doing internships or attending outdoor lectures with teachers);
    4. PhD students (except for students of the University of Wrocław Faculty of Biological Science and students doing internships or attending outdoor lectures with teachers);
    5. people with moderate or mild disabilities;
    6. guardian of a disabled child up to 16 years of age,
    7. seniors from 60 years of age, upon presentation of an identity card.
 

§ 3
E-ticket Refund

  1. The Purchaser has the right to withdraw from the contract of Electronic Ticket purchase within 14 days from the conclusion of the contract without specifying the reasons or bearing a cost.
  2. The Purchaser can withdraw from the contract through submitting the Statement of Withdrawal from the Contract. The Statement, which is available at www.ogrodbotaniczny.wroclaw.pl, should be sent to the Seller by e-mail.
  3. The Botanical Garden is vested with 14 days from the date of receiving the Statement to execute the return transfer order. The sum of money having been paid by the Purchaser – after withdrawal from the purchase contract – will be reimbursed by the same payment method as used by the Purchaser.
  4. In order to meet the deadline indicated in point 1 of this paragraph, it is sufficient to send the Statement before its expiry date.
  5. The Garden is not responsible to the Purchaser for incorrectly made payments. This is the Purchaser to be charged with the commission for an erroneous transaction.
  6. The unused Tickets which have lost their validity are not refundable.
  7. Tickets which have not been used within the opening hours of the Garden and for which no declaration of withdrawal from the contract has been made within the statutory period indicated in point 1 of this paragraph cannot be re-founded.

§ 4
Complaints

  1. Any possible complaints should be addressed to the Seller. Complaints can be submitted via the complaint form, which is available at www.bilety.ogrodbotaniczny.wroc.pl.
  2. A complaint should include:
    1. the Purchaser's personal data agreeing with the data entered during the Electronic Ticket purchase;
    2. the date of purchase transaction, and the transaction number or the number of the receipt or invoice, or any other confirmation of the purchase;
    3. a description of the subject of the complaint.
  3. A single complaint will be considered no later than within 14 days from the moment of its submission.
  4. The Purchaser will be notified whether the complaint has been accepted or rejected, the information sent to the address given in the complaint form.

§ 5
Personal data protection

Based on art. 13 of Act 1 and on Act 2 of the Regulation of the European Parliament and the EU Council no. 2016/679, dated 27 April 2016, with respect to protection of natural persons in connection with processing of personal data, and with regard to free transfer of such data and the repeal of directive 95/46/WE (hereafter referred to as ”RODO”), the Botanical Garden pronounces that: 

  1. The administrator of your personal data, obliged to ensure that their processing is performed in compliance with relevant principles, is the University of Wrocław, at 1 Uniwersytecki square, 50-137 Wrocław;
  2. The administrator has appointed an inspector of data protection, who can be contacted at the following e-mail address: iod@uwr.edu.pl;
  3. Your personal data will be processed by the University of Wrocław:
    1. based on art. 6 of Act 1 (RODO point a.), in order to make a necessary contact, the consent for which follows registration in the on-line sales system, and also for promotion purposes involved with the Garden's activity and related with ticket selling;
    2. based on art. 6 of Act 1 (RODO point b.), in order to establish and execute the sales agreement;
    3. based on art. 6 of Act 1 (RODO point c.), in order to satisfy legal obligations connected with the execution of the concluded contract;
    4. based on art. 6 of Act 1 (RODO point f.), in order to secure and pursue possible claims;
  4. Your data can be made available exclusively to the public bodies and entities authorized to acquire data on the grounds of applicable law, or to entities entrusted with data processing activity based on pertinent contracts with the University of Wrocław.

    Moreover, please be notified of the following:

  5. Your data will be stored for a span indispensable for execution of the contract, after which time for the span and within the scope required by provisions of generally applicable law, or for securing and pursuing possible claims;
  6. You have the right to access your personal data, to correct and delete them or restrict their processing as well as the right to object to the processing of your data. These entitlements can be, however, limited by a specific legal provision;
  7. You are entitled with the right to withdraw your consent which constitutes the legal basis for processing of your data at any moment, without affecting the lawfulness of the processing performed based on your consent before its withdrawal;
  8. You have the right to lodge a complaint to the President of the Personal Data Protection Office;
  9. Providing your personal data is voluntary, yet necessary if your sales contract is to be concluded and executed;
  10. Your personal data will not be subjected to automated decision making.

§ 6
Final resolutions

  1. Tickets bought at the Ticket Office or those purchased via the Botanical Garden's website must not be copied, converted or scanned.
  2. The Botanical Garden does not assume responsibility for the functioning of the Internet system through which Ticket purchase is executed by the Purchaser. The Garden is not responsible for messages or any other data forfeited or lost in the Internet while the purchase is being carried out, or for individual computer settings and methods of configuration, either for settings at the network access providers' or possible service interruptions.
